You are right. That is yet another possibility - one that had not occurred to me. BTW - In regards to

What is the case law for this, since there are very few restrictions on licensing in Title 35 (except for patents obtained with federal assistance)? Also, note that even with such a restriction, I would imagine that only applies to arbitrary restrictions, whereas in this case it would probably be possible to justify different licensing schemes based on the different IPR that the licensees hold.
