I don't think they ever actually bought shares. Don't get excited about this. If you have any doubts about your WAVX position, this could be a great chance to lighten up. Not through the tender, but a sell in the market. I bet the tender never happens.

EDIT: I think they do this in case WAVX pops above the offer. In that case, they buy the shares and then sell on the open market and make the spread. If it stays below the offer, they cancel the offer. The offer itself may drive the stock up. In my opinion this is a slimy operation.
