David,

At the present moment Banyan's Form 10-SB is technically "effective" and
BANY is compelled to file timely reports with the SEC, which it will file its
Form 10-Q for the second fiscal quarter shortly to comply with 12(g) of the
Exchange Act. However, it is still in the comment process of the Form 10-SB
and until there are no more comments it could face possible delisting. When
the SEC is done with comments, the "E" will be removed from its trading
symbol.
