You are correct (in the US). But what makes you think that you cannot borrow it ? I borrowed, shorted and covered while you guys are still struggling with the concept that IPOs cannot be shorted in the first 30 days. I even provided a link to a person's profile who could have clarified it (if you are not aware, Steve is very well informed about the relevant rules)

And what I did is perfectly legal. If you think otherwise, you are welcome to inform the SEC and provide them a link to a post which states that I shorted NTOP.
