Though I do have a small bit of apprehension about giving DD from a pay site to those on a free site (since I assume most of the serious folks from RB are already on this pay site); I have no problem with your paraphrasing the information from my posts in your correspondence on RB.

In clarification of the first-to-file rule, the filing date in the US has no bearing on the filing date in the EU. It is the filing date in the EU that counts towards the first-to-file mark in the EU regardless of any separate action in the US, respective of course of all of the new treaties regarding multiple country filing of patents worldwide. As I said before, these lawyers earn their keep!

Regarding the software patents, if you keep tweaking the application you can extend the 12 month application period on indefinitely in the US (a good lawyer/engineer combination is priceless). It appears to me that is what Jimmy and company are doing with the latest software revisions.

I believe the status of all of the patents should be on the MRPS website in a manner that would not jeopardize any of the information.

As I know more I will report...there are a few more things I want to check out. This patent sleuthing beats my normal morning of slogging through boring technical documentation any day.
