JGoren: You have entered a new element (new to me at least). When, where and how did Nextel beat the FCC in court? Do you see the DOJ and FCC "permission" for a huge public company to take over the "rights" of a small company as consistent with the denial of the Q's request early in its trying to launch CDMA, and the torturous path LWIN had to run - with long delays in both cases?

Just out of curiosity I looked to see if there was a NextWave SI thread and sure enough there is. Fallen into disuse but here:

The chuckle is the lead in at the top. The authors of the telecom reform act (for deregulation - a major power loss for the FCC) are cited at the top as lauding NextWave. Could that have anything to do with the attitude of the FCC's political leadership? No, of course not. Could Nextel have the "right" politics? Again that could not enter. We all know that regulatory bodies are scupulously objective.

Suggest those of you curious re the history of NextWave check out the link above.

So, I am sitting here, reading all about NextWave and Nextel.

I had to re-read the post carefully, after I realized I had blurred in my mind which company was which.

(I wonder if Mr. Erikson of Lucent is still there ...)

Anyway, after a few seconds of fuming over all of this "next" stuff, guess where I pointed my cursor ?

The word "next."
