James, i think Gates was not willing to give up much in settlement talks while the DOJ/States wanted a lot more than most would expect from a court case. The one factor for settlement is so that there is no dark cloud over the Windows2000 parade.
I guess they have to weigh this factor and i bet they are.

The other reason i hold out hope for a settlement is simply the political climate. In a recent poll, MSFT favourable rating slipped but those who want serious action against it dropped. This can only be the hype surrounding Linux and AOL etc. Once i heard Blumenthaul of Connecticut sounding neutral in discussing the Bristol win by MSFT, i got the impression these elected officials don't want to take risks with their political careers. The reason they would feel threatened is simply because it was a jury decision in Bristol's home state (Connecticut). If i was Blumenthaul or any other State AG, i would be worried. If it had been a verdict by a judge, it would not have mattered to him or the other AGs.
