"What the FCC recently did (and maybe MikeM can confirm that this is the ruling he was thinking of) was to approve of the SBC-Ameritech merger on the condition that SBC agree to use a separate subsidiary to compete in the DSL market."

Doughboy,
No, my FCC ruling was not related to the above. But you did bring up another very interesting development that I wanted to comment on anyway.

Seems the SBC-Ameritech deal may go through. But apparently SBC-Ameritech have been writing the rules much to the chagrin of their competitors. I'll try to dig up the article, but I think I already threw it out.

But if the rule goes through as is today, the SBC-Ameritech deal is a major positive for the data CLECs. You see, ironically as part of the ruling, SBC-Ameritech has to prove they have broadband offerings in certain markets. But the way it was written, was too loose. You see SBC-Ameritech could just purchase a Data CLEC to comply. And this is what had the other ILECs angry.

This entire DSL situation sure is bouncing between the ceiling and the wall. New developments happen almost daily. It's so shaky I believe that is what is keeping investors away from certain DSL sectors. Lot's of FCC stuff going on that could have major implications to DSL players.

Gusty call on your valuation of what is causing the data CLECs to take a beating and when to jump in. I'm certainly going to keep an eye out on developments for now.
