BANY is a fully reporting company and in compliance with all of the requirements of 12(g) of the Exchange Act. However, BANY is still in the comment review process of its Form 10-SB. The Form 10-SB goes "effective" 60 days after filing, regardless of whether the SEC is done reviewing which requires companies to comply with 12(g). BANY is doing that, but because it is still in comments the 'E' was added to its trading symbol. Just as soon as BANY is out of the comment period the 'E' will drop off. It is possible BANY could get dropped down to the pink sheets, but if it does it would move right back to the OTC BB when the SEC finishes their comment process. We do not know when this process will end, nor can we discuss it until it is completed. I hope this helps clear up the current situation.
