That's not quite correct. They're against mixing copper and cable markets together whatever their ulterior motive or expressed rationalizations. The FCC is ultimately in favor of open access necessarily. We all are. That doesn't mean they're in favor of non-supporting access. Anyone can use any facility as long as they pay for the use. No one is against this concept. They only disagree in the details.

It isn't the FCC's intent to create a separate and distinct market in cable, but nonetheless that's what they're doing by their actions. It's evolutionary and so it's correct, but it's also correct from an abstract point of view. Cable and copper are materially separate and distinct.

I'm surprised that the legal department at Att hasn't built on this. Instead, they build on what decisions were made in the past and why people can't change them. They underestimate the power of the local community upon which the US Constitution rests.
