I don't think your paradigm argument hinges on this apparent contingency.

True. Whether the install rate increases with open access is no longer important to debate. It is what is best for ATHM, the MSO's, the ISP's, and the consumer.

The whole point is to spur competition. The inevitable outcome will be more and better services and increasing bandwidth culminating in the laying of fiber to the curb much sooner than in the anti competitive environment that exists today.

In reality AOL, T, ATHM, the RBOC's are consolidating their respective positions and trying to create a safe playing field where thay can all get along.
