Motorola was a very early license to QUALCOMM's CDMA.Therefore they have a so called SweetHeart license deal, in which they pay lower royalties then newer entrants into CDMA licensure.Motorola has brought legal action against QUALCOMM and QUALCOMM aganist Motorola.The main point is that Motorola is thriving only because of CDMA's hot growth prospects.QUALCOMM seems to have the upper hand in patent strength ,and if Motorola insist on taking this wayward misadventure in suing QUALCOMM, they are threatened with loosing it all, with QUALCOMM pulling the CDMA license it granted them in the first place.The art of negotiation would seemingly benfit QUALCOMM in having there royalty rates raised in the process of settlement.

G. Moore, thanks for the post. I have a great deal to learn about the Q / Mot legal dispute, and in fact I think I know next to nothing about it. But to gain any real understanding of who is "right" or the relative strength of the positions I believe you would have to read the underlying license agreements. My understanding is that these were not publicly available, but they may become available because they will have to be attached to the parties' pleadings / briefs / affidavits in the lawsuit -- unless they manage to keep it under "seal." If someone knows where these license agreements can be found now, I would appreciate hearing about it. -- idler.
