The way it shapes up imho. Nextwave sharehoders are voting on the restructuring plan which is the buildout of 3G network in their license areas. They will then wholesale it to the folks who want to pay for it. So if the plan is approved, AND they can get new funding for the infrastructure buildout (ala more $ from private investment and maybe an IPO if its looking good), then SURF's up. If not, the sprectrum will be returned.

The way I understand the Nextel deal is that if the shareholders vote down teh plan (VERY unlikely), then the the creditors (including the FCC) can put up the spectrum for sale. Nextel won't be the only folks in that line.
