I think the scenario you describe is plausible and is what I am counting on to happen if the POG doesn't turn up before December. Since I believe Mr. Lang has a good reputation and a track record, the property owners would be better off working with him rather than forcing a default and taking back their property.

By the way, I wonder if Emgold has considered selling out to the South African mining companies Durban Deep or Harmony. I own these shares too and I know that they are looking to diversify into North America. They are both experts in underground mining. Emgold could sell out for maybe 30 cents a share. Besides a 3x gain from the current share price they would get another 3x gain when the acquiring company's share price appreciates when the POG recovers. This would give shareholders a total 9x gain from the current price and minimize the risk going forward.
