The Portland court case is a preliminary ruling at the local level. There is a long way for AOL to go to get open access. Even if it were legislated, if the terms aren't suitable to AT&T then AT&T will make it nearly impossible for AOL from a practical standpoint.

msft is threatening to offer free or almost free net svc. that is why aol and other isp's are anemic.
