Scalia, I would say, really cares about the system that was set up by the founders, the separation of powers, the system of checks and balances.

Renquist, I would say, really cares about the division of government power between state and federal government. O'Connor, as well, to a lesser extent. Kennedy, and Suter, to a lesser extent yet.

Thomas votes with these, and that makes a majority.
