I don't really know what Rehnquist thinks, I believe he is careful not to allow his personal beliefs to interfere with his judging. I think he follows the law as he sees it. He wrote a book recently which I found interesting.

My favorite Scalia story comes from television. He argued that the (hypothetical) convicted killer should be executed even though there was evidence that he was innocent --- "because he had probably done something that deserved punishment by death" and then he he giggled.
What an evil idiot!
