My position is that the federal government is in the position to arrogate to itself powers which may not have been contemplated by the Framer's because it was given the final authority in the federal system to determine such questions, and that the states only have recourse through federal institutions, such as the Supreme Court and the Congress, to try to redress the balance. Since the federal government must relinquish the disputed powers, it is proper to refer to the process as "devolution", even if one thinks that the powers were improperly arrogated in the first place....
