At least they need to get a search permit:

Under the measure, investigators would obtain sealed search warrants signed by a judge as a prelude to getting further court permission to wiretap, extract information from computers or conduct further searches.

Leaked Government Y2K Documents Describe Major Year 2000 Risk to U.S. Cities; Infrastructure Failures Deemed 'Probable'
CODY, Wyoming, Aug. 20 /PRNewswire/ -- U.S. Navy documents leaked to Y2K commentator Jim Lord and now made public sharply contradict information offered by the White House and other government officials on the Year 2000 problem. According to the documents, recently authenticated by Y2K czar John Koskinen, ''total failure is likely'' in the key infrastructure of 44 U.S. cities.
