Dave, "first to do so" may not be enough, were they granted a claim on transferring data on both edges of the clock? I have not read RMBS patents, and it is too big a task, but if someone is familiar with the RMBS's body of intellectual property, they could comment on this. Tate surely did not say that DDR DRAM infringes on any RMBS' patents.

Tate absolutely did not say that DDR infringes on any of Rambus's patents. He said that they can't get the parts to even look at it. It was Marcy who raised the question and therefore may start the rumor (which is why I credited it to her) with her statement "We've heard that double-data-rate DRAMs may be based in part on Rambus technology".

But I don't care who starts the rumor. I like the idea of doing to the DDR crowd what they've been doing for so long to us. As unclewest has pointed out, Rambus has said that they will defend their patents (and I heard Tate say at the annual meeting that they're filing a significant number of patents). As many of our technology experts have pointed out, providing high-speed memory requires a certain set of capabilities. It seems reasonable to me that at some point the DDR folks would have to step on some Rambus toes.
