Since when does a stock have to move constantly? Essentially, the market has been fairly listless the last two months. The tech sector, in particular, has been womped since about April, and is only now gaining again. ORCL, in the face of the downturn in tech, gained over 14 points in the last 3 months. That's better than most other techs have done in the last 2, as it has struggled back as a sector.
You can't have a stock that is continuously moving up. Right now it's channeling, and likely basing for a move past 40. Since it didn't back and fill the gap (as some expected), this channeling has effectively served the same purpose over a longer period of time. Barring bad earnings (unlikely), ORCL is ready to start moving again after earnings.
