djia101362 (btw, we need a name to call you - this handle is a tough one!), IMHO, the spin-off is coming no matter what. I just cannot see Belluzzo taking the job without this being tabled in the negotiations.

He'd better ignore them in the upcoming factual ruling since neither decision has anything whatever to do with the DOJ case. If he doesn't ignore them in the facts ruling, then there would be good cause to appeal even that nearly unappealable the decision.

This makes very little sense. The Sun case will be decided on it's own particular facts and applicable law, and the same is true of Bristol and the pending DOJ case. Sun/MS is a private commercial CONTRACT dispute, and the recent preliminary ruling in that case has, and will have, no effect on the government's antitrust case. It is very dangerous and wrongheaded to predict anything about the outcome of the DOJ case based on events in Sun or Bristol. If you think MS has a "much stronger hand" than the DOJ, fine, but you really can't use the other two cases to support that belief.
