Paul,
The first excellent analysis we have had on this board,
for many weeks.

I spoke with Bob Geiger from FRB today. He said that the company has been assured by CC that they are not shorting and are "in for the long hall". Management is aware of the short attack. No news on the status of the EPS auction.

Paul, it seems that you are now acknowledging that Castle Creek is likely to be shorting the stock (despite FRB's claims to the contrary). I guess you've changed your mind from a few months ago when you adamantly claimed that they would have to report any changes in beneficial ownership to the SEC?

Second, you point out that any shorting by Castle Creek is not necessarily without risk, as has been the case since the price went below the conversion ceiling. Did you consider that if Castle Creek is willing to take the risk of shorting below the conversion ceiling, what that says about their opinion of the direction of the price?

Also, your scenario about a possible abatement of the supposed short attack is not playing out. Today's closing bid price was the second lowest of the last 10. As long as the price keeps falling, there is no reason for Castle Creek to let up (assuming they are at least partially responsible for the pressure on the stock).

"Klemencic's "brilliant" minutiae revisted - New Low Conversion Price."

Its beginning to become clear why early retirement was the best option for Big Oil.

The six lowest closing bid prices for the last ten trading days:

8-18 4 17/32
8-23 4 7/8
8-24 4 3/4
8-25 4 9/16
8-26 4 1/2
8-27 4 5/16
Average = $4.59
Conversion price = $4.63
Conversion amount approx. = 1,661,000 shares versus 1,629,000 based on yesterday's higher conversion price.

CC would get approx. 32,000 more shares with today's continuing decline.

Conversion price = $4.55, down from $4.63
Conversion amount approx. = 1,692,000 shares versus 1,661,000 based on the previous conversion.

CC would get approx. 31,000 more shares with today's continuing decline in conversion price.

Finally, the conversion will recede further tomorrow if the closing bid is not higher than 4 23/32. The 8/18 price does not become stale until Wed. On the upside, the closing bid was up 1/32 from the previous close. ; )

It is once more that time of the day when you learn that dilution has increased again and the conversion price has receded more. Not only is Klemencic's analysis flawed, his timing has never been better from a contrarian perspective. Contrarians everywhere encourage klemencic to provide more guesses soon. ; )

The six lowest closing bid prices for the last ten trading days:

Finally, the conversion will recede further tomorrow if the closing bid is not higher than 4 17/32. The 8/18 price becomes stale after Wed. The closing bid resumed its inexorable decline today after a 1 day hiatus of up 1/32.
