FUTURES SHOCK
Regarding government regulation of the publication of information about commodity futures on the Internet (Leader <http://www.redherring.com/mag/issue66/news-leader.html>): as a Silicon Valley attorney who has battled the U.S. Commodity Futures Trading Commission (CFTC) before, I can tell you that the CFTC's attempt to regulate online publishers threatens the fundamental principles on which the Internet was founded. The CFTC's statutory interpretation requires futures-industry publishers to submit to CFTC supervision or face criminal liability. This is a blatant attack on free speech and freedom of the press. In 1985 the U.S. Supreme Court rebuffed a similar attempt by the Securities Exchange Commission to restrict the First Amendment rights of securities-industry publishers. Prior restraint on the press is a threat to our freedom. The government should stick to regulating the markets and leave the Internet alone.
