Good question. Seems to me the likelyood of a fly being able to live in another sand doon would be extremely high.

Because the fly is protected by a federal act, which mandates that the state protect endangered species, regardless. And the only remedy is to have the statute amended. The opportunity to stop Congress from passing the law, and defining what's on the list, is long gone. If you snooze, you lose.
