Hank, You have it backwards. The burden of proof is on the person making the allegations, not the alleged perpetrator. There is such a thing in law known as libel per se . This means that a person has committed libel unless they can prove that their allegations are true. Can Bill prove that his allegations of stock fraud are true? If not, then he has committed libel, period, end of story. One is innocent until proven guilty in the US, and your claim that Bill's statements are only libelous if proven false go against the tenets of the Constitution. Certain laws protect people from others who make outlandish claims. Is it ok to allege that somebody is a cocaine dealer if they haven't been found guilty of that crime? Is it ok to allege that somebody embezzled money if they haven't been found guilty of that crime? Is it ok to allege that the management of a publicly traded company committed stock fraud if they haven't been found guilty of that crime? Can you honestly tell me that you would answer yes to these questions? With regard to why Bill hasn't been sued in the past, some companies don't want to be bothered by people such as Wexler. To them, he is just a distraction. Other companies might feel that his claims are so outrageous that they ask him to stop. It's also possible that he has been sued in the past and you just don't know it. I don't see where Bill has such a great track record. The only portfolio that he has posted had a miserable performance. He doesn't post his buy and sell points in a timely manner so his performance can't be judged. For example, he posted his buy recommendation on COVD and the stock went up a bunch. That's great, but he didn't post when he sold it until somebody asked him. How does one know that he didn't sell if for 1/2 point gain the day he bought it?
