Bald one, I agree with you. As far as I know, there has not been a court decision on the disposition of the bankruptcy petition of VSI (correct me if I am wrong), and thus TSIG had no business recording on their book any gain (they should have taken a reserve if at all, since the IRS is entitled to exorbitant interest and penalties for payroll taxes not paid on time).

No rational investor in his right mind is going to put in $3 MM of money into TSIG (and without floor, and above market <VBG>) so that they can turn and pay back most of it to the IRS. That is probably why that "funding" is always "next week".

When I took a Business Law course in college there was a whole section on bankruptcy.
What I do remember is that for "personal" bankruptcy, Florida is one of the best states to reside in. (Many people thought that was why OJ was looking to move there)
I'm not sure about businesses though.
I'll have to check further, but I really think that good ole Uncle Sam will always get his money one way or the other.
I'll have to go dust off the books and check further. (They aren't really that old...I was a late bloomer and finished college a couple of years ago) LOL
