FCC gets stay on NextWave appeal

NEW YORK—Chalk one up for the Federal Communications
Commission, which received a stay Aug. 31 pending its appeal of several
lower-court decisions that affirmed aspects of the bankruptcy
reorganization of C-block carrier NextWave Personal Communications
Inc.

Put on indefinite hold as a result of a ruling by the U.S. Court of Appeals
for the Second Circuit is NextWave's Chapter 11 reorganization
confirmation and consummation hearing. That had been scheduled to
occur Sept. 8 before the U.S. Bankruptcy Court for the Southern District
of New York.

The three-judge panel for the Second Circuit ordered attorneys for both
sides to submit briefs within two weeks and said their clerks would
schedule an expedited hearing as soon as possible thereafter.
