At most a lowgrade misdemeanor, and a fine. Which, if you have a security clearance, or a professional type job, might or might not affect your employment status. Carelessly leaving a loaded semi-automatic Uzi lying around where your child can get it, and take it out and shoot her playmates would get a much tougher sentence.

I suspect that the point you are grappling with is the concept called mens rea. You are thinking, this person had no bad intent. Ordinarily, an act isn't a crime without bad intent. It may be civil negligence, but it's not a crime. But there are some laws which make some acts illegal per se, without bad intent. Negligence which rises to the level of willful or wanton disregard of the rights of others may be criminal.

More importantly what if kid accidentally blows off friends head with gun, or "just" cripples friend- then you should be liable for all damages.
