Haven't looked for it, so I don't know, but there might be info here as to whether/when you can or not.

CNBC mentioned a few days ago that the SEC is looking into
the practice of some brokerages that allow what they call
"naked shorting" -- that is, shorting a stock that the broker
doesn't actually have in its possession to lend for the short.

Contrary to what shorters would like to believe, this is not legal,
and the SEC person was quoted in the CNBC piece as having said so.
Apparently the practice is widespread, and explains how a stock can
be driven down to an artificially low price by being sold by people
who don't own it, never owned it, and never will.

I can imagine there is going to be a crazy reckoning coming. The problem the SEC will have is this: if they bring the practice to a halt, it will drive stock prices momentarily so high they give Greenspan major wet dreams and bring on who-knows-how-horrific a rate increase! On the other hand, if they don't stop it, then the American markets will be exposed as just as fraud-ridden as any other market.

What to do?

Not being a short myself, I yearn for the day a certain A@person and his minions start looking desperately for a window on the 13th floor that will open. payback is a bitch.
