Not positive, but depending on timing of votes, definitive merger agreement, you might run afoul of the wash sale rule, which would prevent you from taking the loss. If so, I believe it's not the date you actually receive GBLX stock for your new purchase (of FRO) but the date your FRO entitles you to GBLX stock pursuant to the merger.

pass pass: I agree with Steve. I did that a few weeks ago, (swap GBLX for FRO), but at this point I think it could be a dangerous game to play. IRS may not get it, but then again...
