(Nasdaq: CRUS) today announced that its Crystal Semiconductor division has been awarded an additional $3.8 million damages to cover attorney's fees as the result of its successful patent infringement suit against OPTi, Inc. (Milpitas, Calif.), TriTech Microelectronics Pte Ltd. (Singapore) and TriTech Microelectronics International, Inc. (San Jose, Calif.). The attorney's fees award is directed against the TriTech companies, against whom a stiff, permanent injunction has been imposed that prohibits the sale of numerous infringing audio products in the United States. Cirrus Logic has now been awarded a total of $23.8 million in the case involving its Crystal division's popular Delta Sigma technology. The key patents, which describe innovative techniques for converting analog signals into digital data streams, apply to audio, modem and industrial applications among others. The additional award underscores the July 26th judgment in which the U.S. District Court for the Western District of Texas awarded $20 million to Cirrus Logic. This judgement affirmed the validity of the Delta Sigma patents and determined that the TriTech defendants willfully infringed them. The infringing products from the TriTech defendants were sold into the audio IC market where Cirrus Logic is the acknowledged leader. In a recent market research report published by Forward Concepts (Tempe, Ariz.), Cirrus Logic was named the overall market leader in the $1.6 billion 1998 market for audio ICs. Forward Concepts estimates this market -- which encompasses personal computer, consumer and professional segments -- will grow at a compounded annual rate of 18% to the $3.6 billion level by 2003. Cirrus Logic through its Crystal division filed a Notice of Appeal on August 23, 1999 with the U.S. Court of Appeals for the Federal Circuit. The company has requested the appellate court to reverse the trial court's final judgment (which reduced the jury's award of more than $48 million) and adopt the jury's verdict in favor of Cirrus Logic. The company believes that the Federal Circuit will rule on the appeal sometime next year.
