I find the thought process (or what can only be loosely described as a thought process) of politicians and bureaucrats to be basically unfathomable.

My two cents on relaxation of the spectrum ownership is pretty simple: if the FCC tries to pursue it, the spectrum will be tied up in litigation knots for the foreseeable future. Remember that the C&D block was purported to be the Entrepreneur's Spectrum...and the bidders relied on the ownership rules and restrictions in determining the prices that they would pay and the competition that they would face.

The FCC is now trying to unilaterally rewrite the rules, and this will change the economics of every active participant in the auction. Some will cheer...because it might make it easier for them to sell out to larger companies. Others will fight to the end, for the same reason. The lawyers will win; little forward progress, in my judgment, will ensue.
