Larry, yes, I should have said 'Valence feels justified in their *countersuit* against Klockner,' or, '... in their disagreement with Klockner.' The order of events, however, is that before any legal action began, Valence refused to pay Klockner because the equipment did not work as advertised, and Valence was forced to spend a great amount of time and resources to rebuild the machine on their own. So Klockner sued, and Valence counter-sued.
