Winston: To give you some more background on the subject, GSM networks in Europe and Asia have banded together under the direction of the ITU to establish a set of guidelines for 3G networks. Due to the capacity constraints of GSM, they elected to make CDMA the air interface for 3G networks. ERICY tried to claim that it's WCDMA patents worked around QCOM's IPR. ERICY eventually agreed to purchase QCOM's floundering infrastructure unit as part of a deal to acquire the rights to build CDMA infra networks. As a result, ERICY agreed to pay QCOM on it's IPR covering CDMA

Since the agreement was signed, ERICY has made comments that they expect to control 40% of the infrastructure market. How is that possible? The answer lies in the reality that all existing GSM infrastructure equipment must be converted from GSM to CDMA in Europe and Asia.

Currently, the infrastructure market is beginning to pick up momentum in emerging markets. Also, the level of activity in the established markets like the US is beginning to improve as new CDMA equipment is paving the way for higher capacity and internet access. The process will be in full gear going into next year as Japan and Europe prepare to begin converting their GSM networks to CDMA.
