Or, just get the supreme court to rule that desegregation policies are protected by the constitution, which I'm pretty sure they've already done.< Actually, private discrimination is still completely legal. All the Supreme Court has done is declare public discrimination illegal. And expand the definition of public out of any reasonable shape. But it's still the case that if you want to found a private organization which is exclusively for people of one race, you have the complete right to do so as far as the Supreme Court is concerned.
