No its not an issue, even if that were true, because the DARPA product is quite different from the commercial version they now have. In effect, DARPA got them off the ground, but they quickly had to redesign and start working on another version. So last year they were working on two prototypes, a DARPA version and a commercial version.

And no the Navy does not own intellectual property that ATL Ultrasound came up with. They just funded the project to see if it had military applications (which it does).
