AVNT is still subject to infringement after '94
"We are very pleased the Court has affirmed our right to pursue claims of copyright
infringement -- which, in a recent press release, Avant virtually conceded they are likely to
lose -- and seek what we believe will be significant and substantial monetary damages against
Avant," commented Smith McKeithen, senior vice president and General Counsel at
Cadence. "While the Court's recent ruling, if it stands, limits only one element of economic
recovery in the initial civil phase, we don't believe it reduces the overall effectiveness of our
case, nor does it impact our ability to recover lost profits based on sales of Avant's ArcCell
and Aquarius products."
