You don't have to worry (IMHO). A patent is a patent! No matter when you decide to enforce it...it is enforceable! When a company decides to produce an ICM like device their first decission beyond the concept is to patent that concept. The "violators" would have already applied to patent their product , only to find IIA has already got it. That application and the ensuing violation is indelibly recorded. They are by definition "toast" if IIA chooses to prosecute. As it becomes blatantly apparent that IIA is going to do something about it, there will either be a settlement or a buy out of this company.
