You know, I was thinking it had to be detroit in the 80s. I'm not familiar with the case but it brings up an interesting point... how are hate laws written on the books? For example do they stipulate that if something is a hate crime, then a minimum sentence must be applied? Because sympathetic juries such as this one are part of the problem certainly.

Simple minded on double jeopardy. The same act may break two different laws -- in this case one federal and one state. Each jurisdiction has the separate indefeasible right to try the wrongdoer. Another advantage of federalism and joint sovereignty.
