You said one statute allows for either criminal or civil litigation. Now that my friend is rich. You are so very wrong. I've changed my opinion once again--you are not an attorney because you would be laughed out of court. (Don't forget--you will have a double jeopardy problem if you can have both criminal and civil prosecution by the government for the same act--you had better have different elements.)

My opinion now is that you are a paralegal who works for a third rate attorney. You're the type who knows just enough to be troublesome. I was wondering why you harped on the unlicensed practice of law---because you know that limitation all so very well (and probably resent it because you are so smart!).
