do we know mci actually did make large upfront payment? a bankrupt can disaffirm any executory contract such as it appears to be. that throws mci into creditor status in whatever class it may be, probably unsecured. however, if it affirms the contract, then it is not a creditor in the sense you may mean. i have misplaced the nextwave bankruptcy materials site ramsey sent to me about a month ago, so i can't check the paperwork to see if the contract is mentioned.
