No, the argument does not fall apart, for two reasons: one, we are merciful, and decline prosecution, in various circumstances; and two, if one acknowledges that there is less than certainty about the cutoff, then it makes sense to weigh things differently when the circumstances are especially egregious, and the woman is in no wise responsible for her condition. Now that I think of it, there is a third reason: in a democracy, one sometimes bends to the electorally feasible in order to ensure that some progress is made...I would only make those exceptions during the first trimester....
