Kaye: Generally, in you view, is a convertible note a "substantially identical security"?

For example:
Time 1: Own Stock of Company X below purchase price.
Time 2: Buy Convertible Note (Convertible into Stock of
Company X).
Time 3: Sell Stock of Company X at a loss.

Issue: Is the Convertible Note an "Identical Security"
and, therefore, is the sale of Company X's stock
at a loss subject to the wash rule?
