Actually the CLEC came about because the FCC interpreted the '96 Act in a way so that RBOCs wouldn't be able to commandeer the market for both local and long. It is a blatant refutation of the free market intention of the Act. The government violates its own laws in order to force others to obey them when all they need to do is to fully implement the intent of the law to bring about the purpose of the law's creation. If you want a fair, free, competitive market, you have to stay out of it and let it do its natural thing. That takes trust and government does not trust its citizens. This is the great achievement of political economy of the 20th century. Great.
