Qualcomm Asks Judge to Overturn GTE Wireless Cell-Phone Patent Qualcomm Asks Judge to Overturn GTE Wireless Cell-Phone Patent San Diego, Sept. 16 (Bloomberg) -- Qualcomm Inc., which makes circuits for cellular telephones, sued rival GTE Wireless Inc. asking a judge to invalidate a GTE patent for phones that can identify specific sets of frequencies in a cell system and provide for accessing 911 emergency numbers. In a lawsuit filed in U.S. District Court in San Diego earlier this week, Qualcomm says the GTE Corp. unit accused Qualcomm of infringing the patent, issued to GTE in 1990, in a federal suit filed June 29 in Virginia. San Diego-based Qualcomm contends its technology is different from that of Alphretta, Georgia-based GTE Wireless, and that the GTE patent is invalid and unenforceable. Qualcomm also asks GTE to pay its costs and attorneys' fees after a jury trial. ''Qualcomm has filed counterclaims in the Virginia suit (and has moved to transfer the Virginia suit to this court'' in San Diego, Qualcomm added. Officials of GTE would not immediately comment on the California suit. Shares of GTE Corp., which reported $25.4 billion in sales for 1998, rose 1 1/16 to 71 7/16 in afternoon trading. Qualcomm, with 1998 sales of $3.34 billion, rose 4 1/4 to 178 1/8. NYSE/AMEX delayed 20 min. NASDAQ delayed 15 min.
