Qualcomm Asks Judge to Hold Invalid GTE Phone

San Diego, Sept. 16 (Bloomberg) -- Qualcomm Inc., which makes circuits for cellular telephones, sued rival GTE Wireless Inc., asking a judge to invalidate a GTE patent for phones that can identify specific frequencies in a cell system and call the correct 911 emergency numbers.

In a lawsuit filed in U.S. District Court in San Diego earlier this week, Qualcomm says the GTE Corp. unit sued in federal court in Virginia June 29 accusing Qualcomm of infringing the patent. GTE was issued the patent in 1990, according to the suit.

San Diego-based Qualcomm contends its technology is different from that of Alphretta, Georgia-based GTE Wireless. Qualcomm also claims the GTE patent is invalid and unenforceable and seeks to force GTE to pay its costs and attorneys' fees after a jury trial. ''Qualcomm has filed counterclaims in the Virginia suit (and has moved to transfer the Virginia suit to this court'' in San Diego, Qualcomm added.

Officials of GTE would not immediately comment on the California suit. Shares of GTE Corp., which reported $25.4 billion in sales for 1998, rose 2 3/8 72 3/4. Qualcomm, with 1998 sales of $3.34 billion, rose 6 to 179 7/8.
