It's critical to understand the role the ongoing litigation plays in Gemstar's risk and reward. Their downside risk, if they lose the litigation, is less than their opposition's risk of losing. Conversely, if Gemstar wins, their opportunity is also a lot higher than if their opposition wins.

The present market condition(s) for Gemstar is a state of disbelief IMO. It remains an unparalleled win-win scenario for the most sought after real estate since the Windows user interface. The question is not if but rather how much. The balking comes with the entry fee(s) demanded. This is most appropriately subject to negotiation rather than litigation and I suspect the former will prevail before the latter speaks. Gemstar is not running. It offers no hype. I prefer the walk over the talk.
