DAK, I think the answer is "Yes". They don't get any credit for the first filing- it's just as if it came in anew. That said, it should take less physical time, because they've already seen it once and if the same reviewers are available they'll look for what changed. *BUT* they may again run out the clock with internal debate.

Going out on a limb here, but would expect good possibility that

1. The FDA accepts the filing.

2. Comes back with a lot of questions and discussion until they feel comfortable.

3. If they aren't comfortable then either no dice or *very* restricted label use.

I think we'll likely see restricted label on this in any case, but that would be OK to get started.

BTW, if everybody would just mail me their CLTR shares it would save them the embarrassment of selling them for next to nothing. And don't forget to sign on the back.

I'm happy to buy some of this puppy (kicked out when it dipped below 20) but I'm not going to fight the tape on this one and I guess I'm too dumb to short it :-}
