Stew, if TV Guide will ultimately become a licensee of GMST, then my whole perception of GMST changes. There would be no reason to wait for the outcome of the litigation to take a position in the stock. Is it your opinion that the GMST product and patent position is so superior and strong that TV Guide's current and future IPG cannot compete with the GMST product?

It makes little difference to me what form a settlement takes. Look at the prior failed United Video(TV Guide)-Gemstar JV wherein Gemstar would hold a 49% stake. (Not to be confused with the failed hostile takeover.) I can only ask myself why TV Guide was going to give Gemstar 49% of its IPG business. Many headlines were written when AOL changed vendors from TV Quest to TV Guide for its TV listings feature but for its TV initiative,AOL TV, they exclusively licensed Gemstar. It will be Gemstar in every post Win95 OS and not TV Guide. If anyone can circumvent patents, it is Sony IMO. They have likewise licensed Gemstar for analog TVs and digital STBs. Sony even has the guide in a VCR model.

If I were an engineer or an attorney I would likely have more to say concerning the intellectual property however the actions of major powers in the TV and internet industry lead me to believe that Gemstar is bargaining with TV Guide from a position of strength.

The patents just keep on coming for Gemstar. They were just awarded a patent for IPG advertising even as they are in talks with TV Guide to which Stephens' analyst Corcoran commented in the Sept 6th issue of Broadcasting & Cable: It's hard to overstate the patent's importance for Gemstar
